| As well intended indeed are the masses to protect their
Constitutional rights, the fanfare however seems to be overdone. As long
as the text of the bill remains as is, their is no pending doomsday for a
loss of freedom. |
| The National Defense Authorization Act (NDAA) for Fiscal Year
2012 was signed into law on December 31, 2011 by President Obama. |
| The most controversial provisions to receive attention are contained in
Subtitle D, entitled “Counter-Terrorism.” In particular, sub-sections
1021 and 1022, which deal with detention of persons the government
suspects of involvement in terrorism. These paragraphs have generated
controversy as to their legal interpretations and their potential
implications for abuse of authority. |
|
However, the subtitles mentioned above, clearly state the opposite.
They specify that “United States Citizens” and “lawful resident
aliens” are exempt from this strict legislation.
|
| The current text reads as follows… |
| 1022 (a) (4) (b) addresses:
Applicability to United States Citizens and Lawful Resident Aliens- |
| (1) UNITED STATES CITIZENS- The
requirement to detain a person in military custody under this section does
not extend to citizens of the United States. |
| (2) LAWFUL RESIDENT ALIENS- The requirement to detain a person in
military custody under this section does not extend to a lawful resident
alien of the United States on the basis of conduct taking place within the
United States, except to the extent permitted by the Constitution of the
United States. |

| If it would make you feel more secure, print off a copy of this report
and keep it in your wallet or purse. Then present the report to the
authorities as you are being trucked away by the military to the civil
unrest detention facility in your home state. Then if you wish, simply
repeat… I am an American, I am an American. (The clicking of heals while
wearing red shoes is optional.) |
